This initiative aims to simplify access to economic activities, through the reduction of bureaucracy and simplification of procedures. In this way, it allows economic operators, having met the requirements of the space under the Legal Regime for Urbanization and Building, to start their activity more quickly by electronically submitting a prior declaration of installation or modification.
The regime in question applies to activities carried out in fixed establishments, as well as to itinerant activities, namely the provision of non-sedentary food and beverage services.

When to do
At any time, before the start of the operation of the activity.
Documents
- Taxpayer Number and respective access password;
- Identification of the Owner of the operation of the establishment, mentioning the name or company name and the tax identification number;
- The address of the registered office of the legal person or sole proprietor;
- the address of the establishment or warehouse and its name or insignia;
- The CAE of the activities that are carried out in the establishment, as well as other relevant information for the characterization of these activities, namely the sales area, and the warehouse of the establishment or warehouse, the existing accessory sections, the number of people employed, the type of location and the method of sale. In the case of Prior Communication with a non-Sedentary Deadline, beyond what is foreseen, if applicable, a brief description of the equipment, as well as the municipalities where it will work;
- Document proving the start of the activity (mandatory);
- Date of opening of the establishment to the public or start operating the warehouse;
- Email (required);
- Registration form.

- Annex I - Mere Prior Communication
Prior notification alone consists of a declaration which enables the person concerned to open the establishment immediately, without the need for further formalities. Thus, the entrepreneur assumes that he will comply with all legal requirements related to the activity. The competent inspection and inspection services will monitor the development of the activity "a posteriori".

The mere prior communication with a deadline consists of a declaration that allows the interested party to open the establishment, operate the warehouse or start the activity, only when the city council issues an order of approval. The interested party may also start its activity when the city council does not make a statement within 20 working days after receiving the declaration. The installation or modification of an establishment is subject to the regime of prior communication with a deadline, when the waiver of prior authorizations is requested regarding legal or regulatory requirements mandatorily applicable to the facilities, equipment and operation of the economic activities to be carried out in the establishment.
- Annex III - Street Vending and provision of Catering or Beverage services with a non-sedentary character.
The provision of food or beverage services on a non-sedentary basis consists of the provision, for remuneration, of food or beverage services in mobile or removable units (such as market stalls and appropriate vehicles) or in fixed facilities where fewer than 10 annual events are held. Which activities are covered: the provision of food or beverage services with a non-sedentary nature, in mobile or removable units, located in public spaces, public spaces authorized for the exercise of street vending, or private spaces with public access. Fixed facilities dedicated to the provision of food or beverage services are also subject to prior notice with a deadline, provided that less than 10 events take place in that space Annual. With the implementation of the electronic platform, street vendors and fairground vendors will now fill in Annex III - Prior communication with a deadline for the provision of Catering and Beverage services with a non-sedentary character. In the case of natural persons, attach a document from the Tax Authority indicating the activity code, CAE.

This procedure allows, by means of a declaration and compliance with the legal or regulatory criteria and requirements applicable to the occupation of public space (e.g., installation of an awning, a terrace, a flower box, a waste container, an advertising medium, etc.), to proceed immediately with its installation, after payment of the fees due to the city council.
When the characteristics and location of the street furniture do not respect the defined limits, the city council will analyse the application within 20 days from the date of receipt of the application and its compliance with the legal and regulatory provisions in force, notifying the applicant of the approval order or the rejection order.

Recipients
The following activities are subject to the Regime of Free Access and Exercise of Economic Activities in the Autonomous Region of the Azores, the activities of catering or beverages, trade in goods, the provision of some services or storage.
Notes/Exceptions
Before making the mere prior communication or prior communication with a deadline, the interested party must:
- Comply with the Legal Regime for Urbanization and Building (RJUE);
- Ensure that the use of the building or its fractions for the purpose of installing an establishment is compatible with the regime of use requested from the city council;
- In food and beverage establishments that have dance rooms or temporary entertainment venues, comply with Decree-Law No. 309/2002, of 16 December, amended by Decree-Law No. 268/2009, of 29 September.
Changes to the characteristics of the establishments:
The owners of the operation of the establishments are obliged to keep all the data communicated up to date, and must update them within a maximum period of 60 days after the occurrence of any change. On the other hand, the closure of the establishment must be communicated within a maximum period of 30 working days after its occurrence.
Operating rules for a given activity:
Annex III of Regional Legislative Decree No. 38/2012/A, of 18 September, presents an indicative, non-exhaustive list of the main requirements that must be met by the facilities and equipment of commercial establishments, service providers and warehouses for their operation.
Street Vendor and Stallholder: With the implementation of the electronic platform, street vendors and stallholders will now fill in Annex III - Prior Communication with a deadline for the provision of Catering and Beverage services with a non-sedentary character. In the case of natural persons, attach a document from the Tax Authority indicating the activity code, CAE.
